Tamara S. Wolfson, Partner

Tamara Wolfson has over 25 years experience litigating commercial cases and representing insurers and insureds in complex insurance coverage and bad faith litigation, concentrating in the areas of professional liability, commercial liability, errors and omissions, and directors & officers insurance. Her experience includes:

       
  • Litigating coverage cases arising from environmental contamination and “sick building” syndrome, including securing coverage for a public utility for environmental contamination at multiple coal gasification sites and for claims arising from the installation of urea-formaldehyde foamed-in-place insulation (UFFI);
  • Representing insurers in numerous declaratory judgment actions involving the interpretation and application of their policies;
  • Drafting policy forms and both standard and manuscript endorsements and negotiating policy terms and endorsements;
  • Advising insurers on a wide range of coverage, claims-handling and regulatory issues;
  • Successfully defending the Medical Malpractice Joint Underwriting Association of Massachusetts (“JUA”) in a bad faith case alleging that the JUA wrongfully failed to settle an underlying suit that resulted in a $9,000,000 judgment against the insured;
  • Successfully defending a medical malpractice insurer in a suit alleging wrongful failure to settle an underlying suit that resulted in a judgment in excess of the insureds’ policy limits. Also obtained summary judgment rejecting claim that insurer was required to pay prejudgment interest in excess of the policy limits;
  • Successfully defending an insurer in a suit challenging the validity of claims-made coverage;
  • Counseling insurers and insureds on emerging insurance issues and exposures such as privacy and cyber risks;
  • Advising employers and their employees on disability claims and group disability and other benefit plans; and
  • Securing coverage for a substantial civil rights judgment against municipal officials after their insurers disclaimed coverage.
