Anderson & Kreiger Defeats Claims Against Barnstable Municipal Airport Commission

On June 23, 2010, the First Circuit Court of Appeals affirmed the District Court’s dismissal of federal claims brought against the Barnstable Municipal Airport Commission by one of its tenants, who challenged Barnstable’s policy, approved by the Federal Aviation Administration, of reserving for itself the right to sell jet fuel at the airport. The Court ruled that the Barnstable Commission, and its officials, were immune from anti-trust liability, and had committed no actionable fraud subject to RICO sanctions. The Court also found no persuasive evidence of discrimination by the Commission in violation of the tenant’s right to equal protection.
