In a matter of three short years, the Town of Acton has positioned itself to make a major transition from fossil fuels to green energy sources. With the completion of a new solar facility, Acton will be able to rely on solar energy for the electricity used by virtually all of its municipal buildings and much of its school requirements.
Kevin Batt, counsel with Anderson & Kreiger, provided comprehensive guidance to Acton, including preparation of a comprehensive competitive solicitation of solar developers, meeting with the Department of Environmental Protection (DEP) to pave the way to use the Town’s closed landfill and negotiating with the selected solar company, to conclude a cost-effective power purchase agreement and long-term lease. In December 2011, Acton – one of the state’s first green communities -- executed contracts to site a solar electric generating facility on the Town’s closed landfill and to purchase the power generated from the facility.
This project is the third and largest solar facility hosted by the Town. Two smaller projects were installed in 2010 on rooftops of an elementary school and a Department of Public Works building, with Batt assisting in all procurement and contract details. The Town also collaborated with the Acton-Boxborough Regional School District to install solar systems on the high school and middle school roofs.
The new landfill solar project will have a capacity of almost 1.6 megawatts and is expected to provide sufficient electricity for virtually the entire municipal electric load of over 2 million kilowatt hours each year. Many Massachusetts municipalities are now taking advantage of favorable federal and state incentives to install solar projects at closed landfills.
